Acceptable Use
Policy
Purpose
The purpose of this statement
is to document the Acceptable Use Policy for
subscriber's use of En-Tel Communications'
network facilities and/or services.
Introduction
The En-Tel Communications'
network is a commercial endeavor that was
established to provide access to the Internet.
It is made available to all business, academic,
governmental, and private subscribers for a
reasonable fee.
The En-Tel Communications'
network uses a combination of communications
transmission and specialized switching equipment
to provide a high-speed, wide area
communications network service that provides
inter-organizational connectivity for its
subscribers to other regional, state, national,
and international networks.
General Policy
All information transiting the
En-Tel Communications' network is unrestricted
unless it is listed as unacceptable under this
policy.
It is the policy of En-Tel
Communications to provide its subscribers
electronic access to the broadest possible
number of organizations connected to the
Internet. This is accomplished through
connectivity to one or more state, multi-state,
regional, or national "backbone" networks. All
information that exits the En-Tel
Communications' network and traverses the
numerous other networks to which En-Tel
Communications is directly or indirectly
connected, must conform to the Acceptable Use
Policy governing those networks.
Private Policy
It is the responsibility of
all individual subscribers or subscriber
organizations to:
Respect the privacy of other
users, and not seek information pertaining to
other users without their permission. This
includes, but is not limited to, personal data,
passwords, access to confidential files, or
modification of files belonging to other users.
Use the network service in a
manner that is consistent with ethical practice
and accepted community standards.
Copyright Policy
It is the responsibility of
all individual subscribers or subscriber
organizations to respect the legal protection
provided by copyright and license to programs,
data, and other information that may be
accessible over the En-Tel Communications
network. Consistent with provisions of Federal
Law (17 U.S.C. § 512), it is En-Tel
Communication's policy to terminate subscribers
and account holders who are repeat copyright
infringers.
Designation of Agent to
Receive Notification of Claimed Infringement.
A notification of claimed
copyright infringement relating to material
stored on En-Tel Communication's Network or
systems at the direction of users must be
provided in writing to:

To be effective, a
notification of claimed infringement must
include:
- An electronic or physical
signature of the copyright owner or a person
authorized to act on behalf of the owner of
an exclusive right that is allegedly
infringed.
- Identification of the
copyrighted work claimed to have been
infringed, or if multiple copyrighted works
at a single online site are covered by a
single notice, a representative list of such
works at the site.
- Identification of the
material that is claimed to be infringing or
to be the subject of infringing activity and
that is to be removed or access to which is
to be disabled, and information reasonably
sufficient to permit En-Tel Communications
to locate the material.
- Information reasonably
sufficient to permit En-Tel Communications
to contact the complaining party, such as an
address, telephone number, and, if
available, an electronic mail address at
which the complaining party may be
contacted.
- A statement that the
complaining party has a good faith belief
that use of the material in the matter
complained of is not authorized by the
copyright owner, its agent, or the law.
- A statement that the
information in the notice is accurate, and
under penalty of perjury, that the
complaining party is authorized to act on
behalf of the owner of an exclusive right
that is allegedly infringed.
Unacceptable Use Policy
It is not acceptable to use
the En-Tel Communications' network services or
facilities for any purpose:
- which would violate any
applicable laws or regulations.
- where the meaning of the
message or the content of a file would
likely be highly offensive to the recipient
or recipients.
- which makes unauthorized
entry into the computational, information
storage, or communications devices or
resources.
- which propagate computer
worms, viruses, or transmissions of any
type, which cause disruption to disable or
otherwise impede the recipient's facilities
or equipment.
- to make distribution of
unsolicited advertising.
- which causes disruption
of service due to facilities overload
("flaming").
Responsibility
All users of the En-Tel
Communications' network, whether organization or
individuals, are responsible for publicizing
this Acceptable Use Policy at their locations.
The ultimate responsibility
for assuring the acceptability of use according
to this policy is with the individual end-user
who originates the communication.
Enforcement
En-Tel Communications or its
designee will review alleged violations of this
policy on a case-by-case basis. A violation may
result in denying the user access to the
network, termination of access to all services,
and forfeiture of all fees paid.
Evidence of illegal activities
will be reported to the appropriate law
enforcement authorities.
Policy Modifications
En-Tel Communications reserves
the right to modify this policy at any time.
Subscribers will receive prompt notification of
all changes.
